Tamron Hall Mother’s Day Getaway Contest
OFFICIAL RULES

I. NAME OF SPONSOR: Summerdale Productions, Inc. and American Broadcasting Companies, Inc. 77 West 66th Street, New York, NY 10023 (hereinafter, collectively referred to as “Sponsor”).

II. ELIGIBILITY: Entrants must be eighteen (18) years of age or older at time of entry, and legal residents of the United States and Washington, D.C., with the exception of Alaska, Hawaii, Guam, Puerto Rico and all other U.S. territories and possessions. Void in Alaska, Hawaii, Guam, Puerto Rico and all other U.S. territories and possessions and where prohibited by law.

Any individuals (including, but not limited to, employees, consultants, independent contractors, and interns) who have, within the past six (6) months, performed services for American Broadcasting Companies, Inc., Summerdale Productions, Inc., Tamron Hall, any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the sweepstakes or supplying the prize, and their respective parent, subsidiary, affiliated and successor companies, and immediate family and household members of such individuals, are not eligible to nominate or be nominated. “Immediate family members” shall mean parents, stepparents, children, stepchildren, siblings, stepsiblings, or spouses. “Household members” shall mean people who share the same residence at least three (3) months a year.

III. HOW AND WHEN TO ENTER:
Entry for The Tamron Hall Mother’s Day Getaway Contest (the “Contest”) begins on April 3, 2024 at 12:00 p.m. Eastern Time (“ET”) and ends on April 10, 2024 at 11:59 a.m. ET (the “Entry Period”).

To enter the Contest, entrant must visit Tamron Hall’s official website at www.TamronHallShow.com (the “Website”), click on the Contest-themed link or banner, and follow the online instructions to upload a no more than :60 video sharing an inspirational story about their mom or mother figure (the “Video”) to receive one (1) entry into the Contest. Exact composition of the Video is at the entrant’s discretion, but the objective is to show the judges why they should be selected for this prize.

Each Video must meet the following “Video Requirements” (any Video that, in Sponsor’s sole and absolute discretion, violates the following criteria will be disqualified):

•​Video must feature the entrant ONLY;
•​Video must be in .mp4 or .mov formats and no more than 50MB;
•​Entrant must be the rightful owner of the Video;
•​Video must NOT contain any material that infringes or violates any right of a third-party including copyright, patent, trademark, trade secret or other proprietary rights. For example, Video should NOT contain reference to sports team logos, celebrities, names or logos of businesses, copyright protected music or lyrics, or clips from television shows or movies;
•​Video must NOT include third parties/people, who have not expressly authorized in writing the entrant to feature their name, image, likeness or voice in the Video or otherwise use such name, image, likeness or voice in accordance with these Official Rules (if applicable, any selected winner may be required to verify such authorization in the form of a release);
•​Video must NOT contain subject matter which is, or could be considered, in the sole discretion of the Sponsor, obscene, pornographic, violent (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), defamatory, libelous, discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g., illegal gambling, underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, hateful, degrading, harassing, or otherwise unlawful, tortious or objectionable;
•​Video must NOT contain any content that promotes any particular political agenda or message;
•​Video must NOT contain any personal identification, such as personal names or e-mail addresses;
•​Video must NOT communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate;
•​Video must NOT violate any law;
•​Video must NOT contain any content that is protected by copyright (without the express prior written consent of the owner of such right), including any music or include any recognizable locations or include names and/or descriptions of any copyrighted media production, including, without limitation, films, books, television programming, etc., or identifying descriptions of any media property;
•​Video must NOT contain any derogatory references to Sponsor or any of the “Released Parties” (as defined below); and
•​Video must be in compliance with the Disney Terms of Use available at https://disneytermsofuse.com.

Note: Sponsor reserves the right, in its sole discretion, to disqualify any entry in the Contest if Sponsor views the Video as potentially infringing or otherwise a violation or potential violation of a third party’s rights or if it deems the Video to be lacking in taste, quality, or to be otherwise objectionable. Sponsor reserves the right to waive the Video Requirements in its reasonable discretion. Entrants understand that they are posting their Video at their sole risk. Sponsor is not responsible for any claims arising from the Videos, specifically including, but not limited to, claims for intellectual property infringement and privacy rights violations, as well as violations of the social media platform’s terms and conditions.

In the event of a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible. The Sponsor shall not be responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error, which may occur in the processing of the entries in the Contest. The Sponsor assumes no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of entries. Incomplete entries will be disqualified. Proof of posting a Video is not considered proof of delivery to or receipt by Sponsor of such entry.

Limit one (1) entry per person during the Entry Period. Multiple entries in excess of this limitation may result in disqualification of all entries by such person. Sponsor, in its sole discretion, may disqualify any entry that is deemed inappropriate, illegal or offensive, or otherwise not considered to be a valid entry, and entrant will not be eligible to win a Prize.

Sponsor cannot provide any technical support and accepts no responsibility for ensuring the receipt or successful submission of any entry or entry materials, including, but not limited to, Videos. Mass entries or entries generated by a script, macro or use of automated methods will be disqualified. Sponsor is not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind, including, but not limited to, electronic malfunction or damage of any network, hardware or software. If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation in or downloading any materials from this Contest. For the avoidance of doubt, Sponsor also cannot provide technical support nor assumes any responsibility for a Finalist’s ability to log into Zoom for purposes of participating in the virtual audience, as further described below. Except as otherwise contemplated by these Official Rules, and to the extent entrants may otherwise elect at the time of entry, information provided by you for this Contest is subject to Sponsor’s privacy policy located at http://disneyprivacycenter.com/.

IV. GRANT OF RIGHTS
Each entrant into the Contest hereby irrevocably grants to Sponsor, its designees, affiliates, successors and assigns, the non-exclusive, irrevocable, fully paid, universal license to use, copy, sublicense, transmit, distribute, publicly perform, publish, delete or display the Video, including the featured original artwork, in any media now known or hereafter devised including, but not limited to all forms of electronic media, print media and all forms of internet and wireless protocol in perpetuity and throughout the universe for advertising, marketing, publicity and promotional purposes in connection with the Contest and other advertising and promotions. Sponsor shall have the right, in its sole discretion, to edit, composite, morph, scan, duplicate, or alter the Video for any purpose which Sponsor deems necessary or desirable, and each entrant irrevocably waives any and all so-called moral rights they may have therein.

V. HOW AND WHEN WINNERS WILL BE SELECTED AND NOTIFIED
The winner will be chosen by a panel of judges, as selected by Sponsor, from among all eligible entries received. The judging criteria for all Videos will be: 50% Overall Submission Appearance; and 50% Creativity (collectively, the “Judging Criteria”). The one (1) highest-scoring Video shall be deemed the Prize winner, subject to verification of eligibility and compliance with these Official Rules. In the event of tie, the tied entries shall be judged by an additional based on the Judging Criteria to determine the Prize winner.

Decisions of the judges and/or Sponsor are final as to all Contest-related matters, including, without limitation, in the case of a tie. Final determination of the Winner is always conditional on verification of eligibility and compliance with all rules and procedures.

Potential winner shall be notified by Sponsor or its designated representative on or about April 9, 2024 via email and/or telephone using contact information provided at time of entry.

Sponsor may or may not, in its sole discretion, also announce the winner’s name on-air.

If contact with a potential winner is not made within two (2) days, they will be disqualified and an alternate potential winner will be selected from the remaining valid entries based on the results of the judging. Failure to timely comply with any requirement of these terms and conditions will result in the winning entrant being deemed ineligible for any prize.

Those who have already won a prize from a Tamron Hall promotion within the past ninety (90) days are ineligible to enter or win.

In the sole discretion of Sponsor, entrants may be featured in videotaped and/or broadcast segments of Tamron Hall and/or online on www.TamronHallShow.com and/or the official Tamron Hall social media accounts, or by Sponsor by any means or method whether now known or hereafter devised in all media, worldwide in perpetuity.

VI. PRIZE: One (1) Prize is available. The Prize consists of a three (3) day/two (2) night trip for the winner and one (1) guest to New York, NY to attend a taping of Tamron Hall at ABC Studios on April 29, 2024 (the “Show”) (date and time of taping will be at the sole discretion of Sponsor).

Prize includes:

• Roundtrip economy-class airfare for two (2) persons (i.e., winner and guest) to/from a major airport near winner’s residence and New York, NY (exact flights, schedule and route to be determined by Sponsor, in its sole discretion);
• Two (2) nights standard hotel accommodations (single room/double occupancy) at a hotel in New York selected by Sponsor;
• Local airport ground transportation to and from the airport and hotel in New York, NY as determined by Sponsor;
• Two (2) VIP seats at a taping of Tamron Hall on April 29, 2024 (date of taping will be at the sole discretion of Sponsor); and
• One (1) $250 prepaid gift card which may be used for incidentals.

Travel must be completed on dates determined by Sponsor. Winner and guest must travel on the same itinerary.

Approximate retail value (“ARV”) of Prize = $3,000. Final actual value of Prize will be determined at the time of booking and travel may be substantially more or less depending on point of departure, dates of travel and ticket availability. Some restrictions apply. Airline tickets issued in conjunction with the Prize may not be eligible for frequent flyer miles, and no code share flights may be used. Sponsor reserves the right to structure travel route, on a Sponsor-selected carrier for air travel from a major airport near winner’s residence, in its sole discretion. All aspects of the travel portion of the Prize must be conducted on the dates within the range of options provided by Sponsor, in its sole discretion. Sponsor shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air carriers, hotels and/or other transportation companies or any other persons providing any of these services or accommodations. Sponsor shall not be liable for any loss or damage to baggage.

By entering, each entrant understands and agrees that, if selected as a potential winner, such entrant and their guest may be required to consent to a background check; and failure to sign such consents and authorizations and/or to furnish all required information will result in disqualification. In addition, Sponsor reserves the right in their sole discretion, to disqualify a potential winner if the results of such background check reveal that such potential winner is not eligible to participate in the Sweepstakes or has been convicted of a felony or a crime of moral turpitude, as determined by Sponsor in their sole discretion.

Winner must travel with their guest on the same itinerary. Winner and guest must possess all required travel documents, including a valid photo ID. Guest must sign and return a Liability and Publicity Release within the time frame designated by Sponsor. In the event winner’s guest is a minor, winner must be the parent/legal guardian of such guest and must also sign the Liability and Publicity Release on such minor guest’s behalf. Guest must be ten (10) years of age or older. If winner elects to travel without a guest, no additional compensation will be awarded. Winner is solely responsible for all costs and expenses not specified herein as being awarded, including, but not limited to, meals, tips, hotel incidentals, souvenirs, excursions and additional ground transportation. In the event the prize winner is able to participate in the trip during the mutually agreed upon dates but the taping of Tamron Hall (which has no retail value) does not or cannot take place as scheduled or at all, for reasons including but not limited to scheduling conflicts, cancellations, postponement, or for any other reason, then the Sponsor reserves the right to award the remainder of the prize with no further obligation to the winner.

In the event winner and/or their guest engage in behavior that (as determined by Sponsor in Sponsor’s sole discretion) is obnoxious or inappropriate, threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the applicable experience early, in whole or in part, and send winner and/or guest home with no further compensation.

Prize is not redeemable for cash or transferable, except to a surviving spouse residing in the same household. No substitutions allowed except, at Sponsor’s sole discretion, a prize, or prize element, of equal or greater value may be substituted. Certain prize items are subject to availability and may be substituted by Sponsor for a different item of greater or equal value, in its sole discretion. Gift card/subscriptions are subject to separate terms and conditions imposed by issuer.

Winner shall be solely responsible for any applicable federal, state, and local taxes and/or local laws and regulations, and the reporting consequences thereof, and for any other fees or costs associated with a Prize. Winner will receive an IRS Form 1099 reflecting the final actual value of any Prize valued at $600 or more and must submit a validly executed IRS Form W-9 to claim Prize.

VII. RELEASES
By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor/judges, which shall be final in all respects. By participating in this Contest and accepting any Prize that they may receive, entrants agree to release Summerdale Productions, Inc., American Broadcasting Companies, Inc., their parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the “Released Parties”) from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Contest and/or acceptance or use of the Prizes.

Winner acknowledges and agrees that Sponsor is not responsible for any representation or warranty related to a Prize. Each component of a Prize is subject to the terms and warranties of the applicable prize supplier, and winner must look to such prize supplier for any warranties, terms or conditions related to the Prize.

Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and Entry materials in programming or promotional material, in any media now known or hereafter created or conceived, worldwide in perpetuity, or on a Winner’s list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above-mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation.

VIII. MISCELLANEOUS; WINNERS’ LIST

Void where prohibited. All federal, state and local laws and regulations apply.

Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process and to cancel, terminate, modify and/or suspend the Promotion in the event of tampering or other circumstances, including but not limited to acts of God or civil disturbance that render it impractical or impossible to complete or fulfill the Promotion as originally planned.

Name of the Winner and a copy of these Official Rules will be posted on TamronHallShow.com for at least thirty (30) days after winner is finally determined.
